Terms and Conditions

These Terms and Conditions govern your access to and use of Turbine, including our website, merchant dashboard, checkout pages, subscription tooling, and related services. By using Turbine, you agree to these Terms.

If you use Turbine on behalf of a business or other organization, you represent that you have authority to bind that organization, and references to you include that organization.

Eligibility and accounts

  • You must be at least 18 years old and legally able to enter into these Terms.
  • You must provide accurate account and business information and keep it up to date.
  • You are responsible for maintaining the security of your account, wallet, devices, private keys, and authentication methods.
  • You must notify us promptly if you believe your account or wallet connection has been compromised.

What Turbine provides

Turbine provides tools for merchants to create subscription plans, publish checkout links, and view subscription and payment activity. Turbine is not a bank, money transmitter, broker, exchange, custodian, tax advisor, legal advisor, or investment advisor. Turbine does not provide financial, legal, tax, accounting, or investment advice.

Beta service

Turbine is currently in beta. Features may be incomplete, change without notice, or be interrupted while we test, improve, secure, and scale the service. You should keep your own records, verify important subscription and payment information independently, and avoid relying on Turbine as your only source of business-critical data during the beta period.

Crypto payments and blockchain transactions

  • Blockchain transactions may be irreversible, delayed, failed, or subject to network fees, congestion, bugs, forks, validator behavior, wallet behavior, and other risks outside Turbine's control.
  • Wallet addresses, transaction signatures, token transfers, and other on-chain data may be public and permanent.
  • You are responsible for reviewing transaction details before signing or submitting any transaction.
  • Turbine may display blockchain information, but we do not guarantee that third-party network data is complete, current, or error-free.
  • Unless Turbine expressly states otherwise in writing, Turbine does not take custody of user funds and does not control users' wallets or private keys.

Merchant responsibilities

  • Merchants are solely responsible for the products, services, subscriptions, prices, descriptions, customer support, delivery, fulfillment, refunds, cancellations, chargeback-like disputes, consumer disclosures, and taxes related to their businesses.
  • Merchants must comply with all laws and regulations that apply to their business, customers, products, services, jurisdictions, and use of crypto payments.
  • Merchants must not use Turbine to sell illegal, infringing, deceptive, unsafe, or prohibited goods or services.
  • Merchants are responsible for obtaining all permissions and consents needed to collect or use customer information through Turbine.

Customer responsibilities

Customers are responsible for evaluating merchants, subscription terms, wallet transactions, token amounts, network fees, cancellation rules, and refund policies before subscribing or paying. Any purchase, subscription, refund, cancellation, or service dispute is primarily between the customer and the merchant.

Fees, taxes, refunds, and cancellations

Turbine may charge fees or change pricing for the service. Merchants and customers are responsible for any network fees, taxes, duties, reporting obligations, and third-party charges that apply to their transactions. Unless required by law or expressly stated by Turbine, fees paid to Turbine are non-refundable. Merchant refund and cancellation obligations are controlled by the merchant's own policies and applicable law.

Acceptable use

  • Do not violate laws, sanctions, export controls, intellectual-property rights, privacy rights, or consumer-protection rules.
  • Do not interfere with, overload, reverse engineer, scrape, exploit, or attempt unauthorized access to Turbine or related systems.
  • Do not use Turbine for fraud, money laundering, terrorist financing, scams, market manipulation, evasion of legal obligations, or other harmful activity.
  • Do not upload malware, false information, deceptive content, or content that infringes another party's rights.

Third-party services

Turbine may rely on or link to third-party services such as wallets, blockchain networks, RPC providers, analytics tools, hosting providers, authentication services, and merchant or customer websites. We are not responsible for third-party services, and your use of them may be governed by separate terms and policies.

Intellectual property

Turbine and its software, branding, design, content, and technology are owned by Turbine or its licensors. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use Turbine for its intended purpose. You retain ownership of content you submit, but you grant Turbine the rights needed to host, process, display, transmit, and use that content to provide and improve the service.

Suspension and termination

We may suspend or terminate access to Turbine, remove content, disable checkout pages, or take other protective action if we believe you violated these Terms, created risk for Turbine or others, or used the service in a way that may be unlawful or harmful. You may stop using Turbine at any time.

Disclaimers

Turbine is provided as is and as available. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, and uninterrupted or error-free operation.

Limitation of liability

To the maximum extent permitted by law, Turbine and its owners, team members, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, loss of goodwill, crypto asset losses, blockchain failures, wallet compromises, merchant disputes, or third-party service issues. To the maximum extent permitted by law, Turbine's total liability for any claim will not exceed the greater of the amount you paid Turbine for the service in the three months before the claim or 100 US dollars.

Indemnity

You agree to defend, indemnify, and hold harmless Turbine and its owners, team members, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your use of Turbine, your business, your products or services, your content, your violation of these Terms, your violation of law, or your infringement of another party's rights.

Changes to Turbine or these Terms

We may update Turbine or these Terms from time to time. Updated Terms will be posted on this page with a new effective date. Your continued use of Turbine after changes become effective means you accept the updated Terms.

Governing law and disputes

These Terms are governed by the laws applicable in the jurisdiction where Turbine is organized, without regard to conflict-of-law rules. If a dispute cannot be resolved informally, it must be brought in the courts with jurisdiction over Turbine's principal place of business, unless applicable law requires a different forum.
